How do we send documents?

How are we updated?

Updates on request, or through your client portal. Every attempt is logged with time, address and outcome.

Who prepares the affidavit?

We do. The affidavit of service is drafted from the attempt log, sworn, and delivered with the file. Your office receives a finished affidavit, not a draft to complete.

What form does the affidavit take?

Form 15 Affidavit of Personal Service or Small Claims Form 4, or your firm's template. Drafted and sworn by us. A PDF is standard on every serve, ready for upload to Court Services Online. The original is filed at the Kelowna registry or mailed to your office.

What if the party is evading or cannot be found?

Additional attempts are made as needed, spread across different days and times of day, until the party is served or you tell us to stop. Each is billed at the follow-up rate. If personal service proves impracticable, the court may order an alternative method under Supreme Court Civil Rule 4-4. That application rests on an affidavit of attempted service, so ours is written for it: each attempt with date, time of day, address, what was observed, who was spoken to and inquiries made to confirm the address, with attempts spread across different times and days as evidence of diligent effort.

A refusal is not a failed attempt. Where the party is identified and declines the documents, they are left at their feet and the affidavit records personal service.
